With the first major milestones of the FuelEU Maritime regulation (Regulation (EU) 2023/1805) underway, the Dutch Emissions Authority (NEa) would like to give you an update on the current reporting cycle and upcoming deadlines.
Thank you for your cooperation First of all, we would like to express our appreciation to all shipping companies and verifiers who submitted and verified their FuelEU Maritime Reports by the 31 March deadline. Your proactive approach is essential for the successful implementation of this new regulation, which aims to increase the use of renewable and low-carbon fuels in maritime transport. |

Deadline for Flexibility Mechanisms: 30 April |
|
|
|
|
While the reporting phase is progressing, we would like to draw your attention to the next deadline in the current compliance cycle. Under Regulation (EU) 2023/1805, companies have the option to use flexibility mechanisms: they can bank or borrow compliance surpluses, and pool compliance balances.
Please be advised that the deadline for applying these mechanisms is 30 April 2026.
- Banking and Borrowing: if your ship has a compliance surplus, you may bank it to the next reporting period. Conversely, if there is a deficit, you may borrow a limited advance from the following year
- Pooling: companies may choose to pool the compliance balances of multiple ships to meet the greenhouse gas (GHG) intensity limits collectively
We strongly recommend that companies apply and record the flexibility mechanism in the FuelEU Database well in advance of the 30 April deadline.

Important Update: FuelEU Penalty Payment Process |
|

|
|
The NEa helpdesk has recently received several inquiries regarding the procedures and timelines for FuelEU penalty payments. To provide clarity, we have outlined the upcoming process below.
Timeline for Compliance Deficits If a vessel under your management maintains a negative compliance balance after the 30 April deadline (for applying flexibility mechanisms), the following mandatory steps will occur:
- By 1 May: Your accredited verifier will formally record the vessel’s balance as a 'verified deficit' within the FuelEU Database
- By 1 June: Based on the recorded deficit, the NEa—acting as your Administering State—will issue the official FuelEU Penalty Document
Payment Instructions Please note that you do not need to take payment action until you receive the official FuelEU penalty documentation. The FuelEU Penalty Document will contain all necessary payment instructions and references required to transfer the penalty amount correctly.
