Through this Aviation newsletter, we aim to keep you informed about the latest policy developments and obligations relevant to aircraft operators under administration of the NEa.

EU ETS Monitoring and Reporting Regulation (MRR) amendment batch two |
|
|
|
The adoption of batch two of the amendment of the EU ETS Monitoring and Reporting Regulation (MRR II) is expected in the beginning of September. This revision incorporates additional changes introduced by the EU ETS Directive, in alignment with the Fit for 55 initiative.
Key aspects include the new non-CO2 aviation effects monitoring and reporting obligation, additional allocation for eligible fuels as compensation for the price difference between eligible sustainable fuels and fossil kerosine, and new dates in the compliance cycle. Below is a timeline outlining the expected publication dates for upcoming regulations and new components in the EU ETS reporting cycle, based on the most current information available:

Zero-rating of biomass under the EU ETS in 2024 |
|

|
We kindly want to remind you again to update your monitoring plan, in case you want to claim biofuels and/or eligible fuels under the EU ETS in 2024. This means that you must include in your monitoring plan procedures to determine the biomass fraction and necessary documentation to support the zero-rating of biomass.
We have created a roadmap outlining the steps needed to zero-rate biofuels:

Currently, this roadmap focuses exclusively on the zero-rating of biofuels. It also details the evidence requirements of the temporary national measure allowing zero-rating from January 1, 2024, to December 31, 2024. This interim solution will remain effective until the Union Database becomes fully operational for this purpose.
The monitoring requirements for eligible fuels for allocation of emissions allowances as a compensation of the price difference between eligible fuels and kerosine are the same and need to be included in your monitoring plan.

Onboarding reporting tools: ETS Reporting Tool |
|
|
|
We are pleased to inform you that we plan to transition aircraft operators to the digital EU ETS Reporting tool from the European Commission (DG CLIMA). This IT tool is designed to assist you in completing your compliance tasks with the NEa more efficiently. With this tool, you can manage the following EU ETS compliance tasks in one place:
- User and contact management;
- Create, manage and submit your monitoring plan;
- Create, manage and submit your annual emissions report;
- Request verification of your annual emissions report and submission.
The NEa will soon start appointing aircraft operator users to the EU ETS Reporting tool. We will appoint the designated EU ETS monitoring plan contact person as specified in your latest approved monitoring plan. After having been appointed as an administrator by the NEa, you will receive an e-mail with a link to access the EU ETS Reporting Tool.

Onboarding reporting tools: 2. ReFuelEU Aviation EASA Sustainability Portal |
|
|
|
Aircraft operators under the administration of the Netherlands for ReFuelEU Aviation should have received an invitation link from the EASA Sustainability Portal to activate their accounts. The NEa designated one admin user per aircraft operator. Please check your inbox for an email from no-reply@easa.europea.eu with the subject ‘Important: action required for your EASA Sustainability Portal (ReFuelEU Aviation) account. The email contains instructions on how to activate your account. Once you have activated your account you can manage user roles in the portal.

Save the date: Online information session 12 November |
|
|
|
We would like to inform you that we are planning an online information session about the recent important updates to the EU Emissions Trading System (EU ETS) for the aviation sector on Tuesday November 12th. During this session, we will cover the new monitoring and reporting obligation such as non-CO2 aviation effects, the zero-rating of biofuels and other important updates. You will receive an Outlook-invitation to this online information session in due course.
