Checklist Aircraft Operators for reporting biofuels in 2024 under EU ETS |
|
|
|
The Ministry of Infrastructure and Water Management recently sent you a letter regarding a temporary measure in the Netherlands to facilitate the evidence requirements for zero-rating biofuels under the EU ETS, ahead of the full implementation of the union database. During the period from January 1st to December 31st, 2024, the Dutch Emissions Authority (NEa) is implementing this temporary measure. The interim solution will remain in place until the Union Database is fully operational for this specific purpose. We have created a step-by-step guide on how to report biofuels in accordance with the temporary measure for the 2024 emissions year. Please note, cooperation from your fuel suppliers is needed. Furthermore, the ISCC is currently developing a system that can create a proof of compliance (POC) for biofuels. The European Commission plans to include this option in its revised guidance document, which will be released in the fall. We will share more information as it becomes available.

ReFuelEU Aviation – obligations for Aircraft Operators |
|
|
|
The NEa is the competent authority for aircraft operators falling under administration of the Netherlands for the ReFuelEU Aviation regulation. The NEa is responsible for enforcing the regulation and imposing fines for aircraft operators if found non-compliant. In preparation of the first reporting cycle, onboarding of the ReFuelEU Aviation Sustainability Portal will start soon. The NEa will start inviting aircraft operator users to the online portal. Once your administrator has activated the account, further management of users can be handled by your administrator. The invitation will be sent to our designated EU ETS contact or another known contact person. Please keep an eye out for an activation email from the portal. The European Commission is currently revising and developing new regulations related to the EU ETS and CORSIA. The NEa is collaborating with the ministries to offer feedback on the draft versions of the regulations whenever possible. Below, you'll find an overview of the anticipated upcoming publications:
- Revision of the EU ETS Monitoring and Reporting Regulation (EU 2018/2066) (second batch), expected June 30th, 2024. Revisions include monitoring and reporting requirements of sustainable aviation fuels and eligible aviation fuels for free allocation, and non-CO2 effects.
- New: CORSIA offsetting calculations, expected June 30th, 2024. Regulation for Member States on how to calculate the CORSIA offsetting requirement of aircraft operators.
More practical information on these developments will be shared after the official publications.

Below is an overview of upcoming activities and deadlines for the NEa:
- We are preparing the free allocation of emissions rights for 2024. The European Commission is calculating allocations for 2024 and 2025 based on your reported 2023 emissions and the new cap for aviation. We were informed by the Commission that the Commission’s Decision on allocation is delayed and might be published only after the deadline of June 30th. Since we can only transfer your allocation after publication, this means that you might receive your allocation and notification on allocation after June 30th.
- We are preparing the Article 21 report to the European Commission. This report provides information on the EU ETS emissions reports for emissions year 2023. The deadline is June 30th.
- We are preparing the CORSIA State Reports to ICAO. The deadline is July 31st. ICAO calculates the sector growth factor based on each state’s report. The sector growth factor is required to calculate the offsetting requirements for aircraft operators, which we will communicate to you by November 30th.
